Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the Neari mobile application and related services operated by Neari. By creating an account or using Neari, you agree to these Terms and our Privacy Policy.
The service
Neari is an 18+ nearby Plan app. You can see Plans that are already happening around you (about 2 km on the free map), open a Plan from your current location, join someone else’s Plan, and message hosts in range. Neari is not a dating, matching, or hookup product. Neari does not list places as destinations and does not let you remotely browse a whole city.
Eligibility
You must be at least 18 years old and able to form a binding contract. By using Neari you confirm you meet this requirement. Accounts for users under 18 are not allowed and may be removed.
Accounts
You are responsible for your login credentials and for activity under your account. Provide accurate information. You may sign out or delete your account in Settings. We may suspend or terminate accounts that violate these Terms or create safety risk.
User content and conduct
You keep ownership of content you post (Plan covers, one-liners, messages, and profile details), and you grant Neari a worldwide, non-exclusive license to host, display, and distribute that content as needed to operate the service. You agree not to:
- Use Neari to solicit romance, dating, or hookups, or to treat Plans as dates.
- Open or join Plans in bad faith, spam Join, or ignore the nearby range to browse a city remotely.
- Harass, threaten, or dox other people in Plans, Forum, or Messages.
- Infringe intellectual property or privacy rights, including posting photos of others without consent.
- Abuse, scrape, reverse engineer, or disrupt Neari, or attempt to bypass paywalls or manipulate coin balances.
We may hide Plans, remove content, and take action on reports and blocks. Support contact appears in Settings.
In-App Purchases
Neari may offer optional paid digital items through the Apple App Store, including auto-renewing VIP subscriptions, virtual currency (coins), Extra (a second concurrent active Plan), Extend, Highlight (Nearby map pin styling only; Forum feed order is not sold), and See more. Free nearby browsing and joining Plans that are already in range remain available without purchase. Payments are processed by Apple, and Neari does not collect payment card or other payment-account information.
Purchased items are licensed for personal use within Neari, have no cash value, and may not be sold, transferred, or redeemed for cash, except as permitted by Apple Family Sharing. Purchased virtual currency does not expire. Coins spent on Extra, Extend, Highlight, or See more are consumed when the action succeeds and are not refunded if a Plan later ends.
VIP subscriptions renew automatically unless canceled at least 24 hours before the current period ends. You can manage or cancel subscriptions in Settings → Apple Account → Subscriptions. Payment is charged to your Apple Account at purchase or within 24 hours before renewal. If a free trial is offered, any unused portion may be forfeited when you subscribe.
Eligible purchases can be restored after reinstalling the app using the Apple Account associated with the purchase (Restore Purchases in Settings or on the VIP page). Refunds are handled by Apple. If Apple refunds or reverses a transaction, Neari may revoke the related items or benefits.
Apple may provide limited transaction information, such as purchase entitlement, transaction identifiers, and subscription validity periods. Neari uses this information only to provide and restore purchased benefits, and does not use it for advertising, marketing, or sale.
Free features and limits
Seeing nearby Plans within about 2 km, joining an open Plan, and sending messages to a host you can already see does not require payment. A second concurrent active Plan (Extra), Extend beyond the free duration pool, Highlight on the Nearby map pin, and expanding the map with See more may require coins or VIP. Free and paid rules may change; we will update in-app messaging when material changes occur.
Intellectual property
Neari branding, app software, map chrome, and related designs are owned by Neari or its licensors. You may not copy or redistribute them except as allowed through normal app use.
Disclaimers
Neari is provided “as is.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation or accurate distances.
Limitation of liability
To the fullest extent permitted by law, Neari and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill arising from your use of the service. Our aggregate liability for claims relating to Neari is limited to fees paid for digital purchases through Apple in the twelve months before the claim, if any, except where law requires otherwise.
Termination
You may stop using Neari at any time and delete your account. We may suspend or end access if you breach these Terms. Provisions that should survive (including licenses already granted for content already published, liability limits, and purchase terms) will survive termination.
Changes
We may update these Terms. Updated Terms will appear in the app with a new date. Continued use after the update constitutes acceptance.
